Risk Retention & Transfer

We were retained to help assess the cyber maturity and privacy vulnerability of an organisation involved in the processing of personal data on millions of individuals for the UK government.

The analysis was split into key workstreams focused on: the security of the existing IT estate, the organisation’s principal processing activities, the categories of data concerned, the people involved, and the enabling systems and software. Exposures were then evaluated on a range of scenarios, modelling a variety of financial and reputational consequences.

These findings were then used to: help the organisation’s executives to assess their appetite for risk retention, evaluate the adequacy of the organisational and technical measures employed (per GDPR), as well as the adequacy of existing insurance and other third-party contractual arrangements. We then measured the client’s insurability through the maturity evaluation of key technical controls required by insurers.

Erasure Requests

We handled erasure requests, including requests relating to professional records, and advised individuals on delisting requests relating to web search results.

One client was a professional who was plagued by web search links to historic reporting of a dispute with his employer which had included High Court proceedings. Subsequent proceedings before the professional’s regulator had not resulted in any adverse findings – a fact which was not evident from web search results.

We formulated delisting requests which were initially rejected by the search engines. We drafted complaints to the ICO and obtained supportive decisions that led to the delisting of all the links that had been the subject of our client’s request.

Advising a high-profile university on compliant cross-border dataflows and transfers in relation to international students.

Our advice ranged from data protection compliance (including privacy notices) to the establishment of a framework (including ITDAs) and contractual negotiations with key stakeholders.

Data Breaches

We represented several public bodies in resolving claims by individuals for breach of confidence and misuse of private information after staff passed and occasionally sold their personal information to national newspapers. These cases were exposed by Operation Weeting, a Metropolitan Police investigation into allegations of phone hacking, and Operation Elveden, an investigation into allegations of inappropriate payments to the police by those involved with phone hacking.

A number of the individuals were (or had been) serving high-profile prisoners or suspects in high-profile criminal investigations.
